Topic: Workers' Compensation
Fault is not an issue in determining whether a workers' compensation claim is compensable. Therefore, it doesn't matter whether the injured worker is/was responsible for her claim, so long as fraud is not the cause. That being said, if the injured worker is found to have committed a safety rule violation which causes the accident, workers' compensation benefits will be reduced by 50%.
